Sure you can give him a static IP, he can set up an SMTP server and the
whole thing under can run under his domain, regardless you can still get the
heat for it. All it will take is a coule whois queries and they know who
owns the IP addresses for the domain. Guess what? You can still get the heat.
Had to this myself twice recently.

Only if more ISP's would cooperate more with such things. Locally a good
thing would be to exchange blacklists (especially for break-ins). Though to
be sure if I terminate someone and receive a complaint from a user/customer,
I will contact that admin and advise him of an ex-user's history.
My advice would be to say no and let him go elsewhere and if you get
anything from him from another system, contact the admin there and advise
them of the situation.
When I hear "Well I can get this <somewhere>.." just have to say do so then.
