Had a similar experience here with Motorola 56k PCI internals. Specifically
the Modem Surfer line. We referred them back to Motorola who told the
customer that they are no longer in the consumer modem business, they will
RMA the modem under warrantee, but not guarantee the V.90 connection as they
have no plans to upgrade the firmware.

The user tried to return the modem and found Future Shop had closed it's
doors. He replaced it with a Zoom and it works fine...
